1. Agreement

These Terms govern your access to and use of Benchmak (the “Service”), a website-intelligence and prospecting tool. By creating an account you agree to these Terms on behalf of your organization.

2. Acceptable use

Benchmak provides analysis of publicly available business websites and public business contact information for legitimate B2B sales and marketing. You agree to comply with all applicable laws, including anti-spam (e.g. CAN-SPAM, CASL) and data-protection laws (e.g. GDPR, CCPA), when contacting businesses you discover through the Service. You will not use the Service to harass individuals, send unlawful messages, or process data for purposes prohibited by law.

3. Credits and billing

Paid plans and credit purchases are billed through our payment processor. Credits are consumed when you run audits. Fees are non-refundable except where required by law.

4. Data

The Service compiles information from publicly accessible sources. You are responsible for your own use of any data you export. We process data as described in our Privacy Policy.

5. Warranties & liability

The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, Benchmak is not liable for indirect or consequential damages.

6. Changes
